Below is my commission policy, please read through the entire policy before contacting me for a commission. This form must also be submitted in order to commission me. If you submit this form, it is understood that you have read through the whole policy and agree with it.


GENERAL

  1. I ask that the client only approach me for a commission if they are actually wanting to commission me. Please do not discuss detailed plans if you are not serious about commissioning me. If much time is spent discussing a possible commission, only for it to not happen, both my time and the client’s are wasted. I do not mind simple questions, but coming up with a plan with no intentions of actually commissioning me is what I wish to avoid.

  2. I ask for a down payment before I start the commission. This is to ensure that any time and materials I have used are compensated if the client should back out of the commission. Typically I ask for half down, but this can be flexible and I am willing to discuss it further.

  3. No haggling or negotiating. Discounts or free art is given at my discretion. Unless decided otherwise by me, and agreed upon by the client, the price I quote is the price of the commission. I will not reduce the price in exchange for dates, outings, or the like. I will not reduce the price in exchange for “exposure,” or because my art is “not worth the price.” If given a discount, please do not tell your friends or family that I will give them a deal. This could cause more and more people to approach me wanting a discount, and as said above, discounts are given at my discretion. 

  4. Please do not use commissioning me as a means to get to know me. I am more than willing to meet people and become friends through conventional means. I do not use my art business as a dating service or a way to make friends. If the client only intends to commission me in order to become romantically or platonically involved, I ask the client to refrain from doing so.

  5. Please have reference material or ideas ready before commissioning me. I do not expect every detail to be planned out, and I am more than willing to bounce ideas and brainstorm. However, I ask that some ideas are ready before commissioning me instead of, “Whatever you want to do.” This is both frustrating and too vague and can cause undue hardship on both me and the client.

  6. I am a fine artist, and fine art often takes time to make. I unfortunately will not be able to complete things on very short notice. Paintings can take anywhere between 2 days and 2 months to complete, not including drying time. Drawings can take up to two weeks to do. Please keep this in mind when approaching me for a commission. I have more things that require my attention outside of my business, and I also need time to rest, drying time, and more.

  7. I will make the effort to periodically update the client throughout my completing their commission. I ask that the client makes an effort to respond. Otherwise, I will assume that the client no longer wishes to commission me. Responses that take longer than a week will cause me to assume my services are no longer wanted, unless there are extenuating circumstances. Bottom line, I ask for communication between myself and the client.

  8. The client will not take a photo of or scan the art piece and sell it as prints. The client will not resell the art piece unless I give permission. While the art piece is in possession of the client, copyright remains with me.

  9. I retain copyright of the art piece and copyright laws apply. All pieces are copyrighted by Courtney Clegg Art LLC.


PAYMENT AND REFUNDS

  1. I currently accept the following as forms of payment: Purchase through my website, PayPal, Venmo, CashApp, and cash. I do not accept wire transfers at all, and only accept personal checks on a case-by-case basis. I am currently looking into more options, so more will come in time.

  2. I require a down payment before starting the commission and will not start it until that down payment is received. Unless discussed otherwise, I will not deposit the down payment into my bank account until the commission is completed and approved by the client.

  3. The remaining amount is due when the client approves of the commission. I will not send/deliver the art piece until the last payment is received.

  4. The client is responsible for shipping costs if shipping is needed.

  5. If I am maintaining contact and the client is not responding, I will assume the client no longer wants my services and the client will not receive a refund or the art piece. The art piece will be in my sole possession and remain my property. Extenuating circumstances will be considered on a case-by-case basis. However, if I am “ghosted” by the client, and I reach out multiple times only to not receive a response, and there is no extenuating circumstance communicated to me, there will be no refund.

  6. The client simply changing their minds is not eligible for refund. Extenuating circumstances will be considered on a case-by-case basis.

  7. If the client and I agree on a commission and it is started, and during the commission the client asks for repeated revisions, an extra fee will be added to cover time and matierals. With the more permanent nature of fine art, making revisions is tough and costs time and materials. It is not easy to make repeated revisions and using more materials costs me more money.

  8. If the item is shipped and arrives damaged or is lost, I require the client to communicate that with me so that I can contact the post office. While I am not responsible for what the carrier does, I cannot file a claim if I am not notified of damage or loss. If there is damage, please send me a photo of the damage. I will do my best to make it right, but I ask the client to keep in mind that I am a small business and run my entire business myself. A refund will be given in the event of  a missing package or damage. However, please do what you can to find the package in your home or at your neighbors’ porches before contacting me.

  9. Situations where I will accept a return of the commission include: the piece is damaged in transit, somehow the client got a commission that is vastly different than what they approved of upon completion, or in extenuating circumstances on a case-by-case basis. I will NOT accept returns because the client simply changed their mind or did not like the art piece that was previously approved.

  10.  I am willing to discuss options if the client genuinely wants to commission me and finances are an issue. Options like payment plans, and smaller sizes can be discussed. There are also different types of prints available as well. Please contact me if pricing is a concern, and we can find a solution together.


PRIVACY AND TERMS

  1. I will not use the reference photo(s) given to me for any purposes not discussed with and agreed upon by the client. Your privacy and boundaries are important to me. Unless otherwise discussed and agreed upon, I will not use the reference photo(s) for future projects.

  2. Unless otherwise discussed and agreed upon, I will not use any part of the completed commission for anything besides that – the commission. I will not make prints or any other products out of the completed commission. I do, however, reserve the right to upload pictures and video of the completed commission to my social media and portfolio unless requested not to.

  3. The client will not assume copyright of the completed commission. Copyright stays with Courtney Clegg Art LLC. Any attempts to recreate the art piece, make prints from it, or resell it without discussing with me first, are prohibited.

  4. If for any reason I keep the art piece (see above section) the piece and all rights to it stay with me. This means that I can paint over it for future projects, sell it, throw it away, etc and it will be at my discretion. 

  5. Any personal information (names, address, etc) will only be stored by me for bookkeeping and business records. I will not store them to send spam, nor will I sell your information to others.

  6. Please only use the email provided in this policy for purposes relating to commissioning me – requesting a commission, discussing terms, reporting damage, or maintaining contact throughout the process.
